1. Agreement to Terms

By accessing or using WealthSpark AI ("WealthSpark," "the App," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

2. Description of Service

WealthSpark is a personal finance education and management application that provides:

• AI-powered financial coaching and advice
• Bank account aggregation and transaction tracking
• Financial education content and quizzes
• Budgeting and wealth projection tools
• Goal setting and tracking features

3. Eligibility

To use WealthSpark, you must:

• Be at least 18 years of age
• Be a resident of the United States
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the service under applicable laws

4. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

5. Bank Account Linking

WealthSpark uses Plaid Inc. to connect your bank accounts. By linking accounts, you:

• Authorize Plaid to access your financial information
• Agree to Plaid's End User Privacy Policy
• Understand that we receive account and transaction data (not your login credentials)
• Can disconnect accounts at any time through the App

6. Subscription and Payments

6.1 Free and Paid Features

WealthSpark offers both free and premium subscription tiers. Premium features require a paid subscription.

6.2 Billing

• Subscriptions are billed monthly or annually as selected
• Payment is processed through Apple App Store or Google Play
• Subscriptions auto-renew unless cancelled before the renewal date

6.3 Cancellation

You may cancel your subscription at any time through your device's app store settings. Cancellation takes effect at the end of the current billing period.

7. Acceptable Use

You agree not to:

• Use the App for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App's functionality
• Upload malicious code or content
• Impersonate others or provide false information
• Use the App to harass, abuse, or harm others
• Reverse engineer or attempt to extract source code
• Use automated systems to access the App without permission

8. Intellectual Property

All content, features, and functionality of WealthSpark are owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.

9. AI-Generated Content Disclaimer

WealthSpark uses artificial intelligence to provide financial guidance. You acknowledge that:

• AI responses are generated automatically and may contain errors
• AI advice is educational and not a substitute for professional financial advice
• You should verify important information independently
• We are not liable for decisions made based on AI-generated content

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEALTHSPARK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE APP.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS.

12. Indemnification

You agree to indemnify and hold harmless WealthSpark and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

13. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination:

• Your right to use the App ceases immediately
• We may delete your account and data
• Provisions that should survive termination will remain in effect

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes through the App or via email. Your continued use after changes indicates acceptance of the new Terms.

15. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of California.
